Terms and conditions
Maryland Blacktop, LLC and the customer(s) for the
consideration named, agree that Maryland Blacktop, LLC shall furnish all
materials, labor, clean up and perform all work described at the said property.
Only the boxes that are marked on the front of this proposal will apply. All
addendum’s/changes ordered shall be in writing and signed by both parties
hereto to be effective. All permits/approvals including but not limited to HOA
, city, county and/or state are the customer(s)/property owners responsibility
prior to start date.
All time estimates for either the start or completion of
work are approximate only. Maryland Blacktop, LLC shall make every effort to
adhere to such time considerations, however it shall not be liable for any penalty
or damages as a result of any delay, including but not limited to strikes,
casualty, unavailability of materials or weather. All vehicles, trash dumpsters
or anything interfering with the area(s) being paved/sealcoated must be moved
the day prior of start date.
Balance due upon completion of work. No retention allowed.
Deposits are not refundable. A 3% surcharge will be applied for credit/debit
cards. A $25.00 return check fee will be applied plus any other collection
costs. Any past due accounts will be subject to a 10% interest charge per month
(120% per annum), plus all collection costs including but not limited to court
costs and attorney fees. Time is of the essence.
Maryland Blacktop, LLC will not be held responsible for
service disruption of utilities (electric, water, gas, cable and phone) not
marked by Miss Utilty. If you have any clean outs, drain pipes, meters or other
underground installed utilities please make Maryland Blacktop, LLC aware at
least 72 hours before start of work. All vehicle traffic must stay off new
asphalt paving work for at least three days (72 hours) after completion and no
vehicle and pedestrian traffic at least one day (24 hours) after sealcoating,(pets
included) unless otherwise noted. All parties acknowledge that paving materials
may be slippery when wet and may track onto other surfaces while new. Maryland
Blacktop, LLC shall not be held responsible for damages or injuries as a result
thereof. This document shall be construed as a limited time proposal and cost estimate
only and not a contract, until executed by all parties. Time is of the essence.
Warranty
Workmanship is warranted for a period of one (1) year
following completion, provided that Maryland Blacktop, LLC receives written
notice of any defects and an opportunity to repair. Warranty is limited to such
repairs and Customer(s) shall not be entitled to any other damages whatsoever.
Sealcoated/paved or any alterations to pavement structure including but not
limited to saw cutting, stamping, etc. by any other entity except Maryland
Blacktop, LLC shall void warranty. Maryland Blacktop, LLC makes no warranties
and is not responsible for water control/drainage, snow plowing/melting,
chemical damage, vegetation growth or damage from commercial vehicles. (Commercial
vehicles are anything over ¾ ton and/or with duel wheels) It is the
responsibility of the customer(s) to have all exposed or raised edges
back-filled to grade to prevent breaking and cracking.
